These Terms of Service ("Terms") govern your access to and use of the NitroWatches website, including https://www.nitrowatches.com, and any products, services, features, or content made available through it (collectively, the "Service").

Throughout these Terms, "NitroWatches," "we," "us," and "our" refer to the business operating the Service. "You" and "your" refer to any visitor, customer, or other person accessing or using the Service.

By accessing the Service, placing an order, or purchasing a product from us, you agree to these Terms and any policies incorporated into them by reference.

If you do not agree with these Terms, you should not use the Service.

Nothing in these Terms is intended to exclude, restrict, or modify consumer rights that cannot legally be excluded or restricted under applicable law.

1. Eligibility and Use of the Service

By using the Service or placing an order, you represent that:

2. Products and Product Information

We make reasonable efforts to display our products and their characteristics as accurately as possible.

Product photographs, videos, illustrations, measurements, specifications, descriptions, colors, finishes, packaging, and other information are provided to help you understand the product before purchasing.

The appearance of colors and finishes may vary slightly depending on lighting, photography, manufacturing tolerances, and the display settings of your device.

Minor differences that do not materially affect the nature, functionality, or quality of a product may occur.

Nothing in this section limits your rights where a product is materially defective, incorrect, or does not conform to the description provided at the time of purchase.

3. Prices

Prices are displayed in the currency indicated on the Service.

We may change prices at any time. Price changes will not ordinarily affect orders that we have already accepted.

The price applicable to your purchase is the price displayed during checkout, subject to correction of genuine pricing or technical errors as described in these Terms.

Your bank, card issuer, PayPal, or other payment provider may apply foreign exchange rates, currency conversion charges, international transaction fees, or other charges that are outside our control.

NitroWatches is not responsible for charges independently imposed by your financial institution or payment provider.

4. Orders

Submitting an order does not necessarily mean that we have accepted it.

After placing an order, you may receive an automated confirmation acknowledging that we have received your order. This acknowledgment does not prevent us from reviewing the transaction for payment authorization, product availability, fraud prevention, pricing errors, shipping restrictions, or other legitimate issues.

We reserve the right, where permitted by applicable law, to refuse or cancel an order before shipment for reasons including:

• The product is unavailable.

• Payment cannot be authorized or verified.

• We reasonably suspect fraud or unauthorized payment activity.

• Shipping to the supplied address is unavailable or restricted.

• The quantity ordered appears inconsistent with ordinary personal use or appears intended for unauthorized resale.

• Material information provided with the order is inaccurate or incomplete.

• A material pricing, technical, inventory, or listing error occurred.

• Fulfilling the transaction would violate applicable law or regulation.

If we cancel an order after receiving payment, we will refund the amount we are required to return to the original payment method.

5. Pricing and Listing Errors

Although we make reasonable efforts to maintain accurate information, errors may occasionally occur.

A product may, for example, be displayed with an incorrect price, discount, description, availability status, shipping charge, promotional offer, or specification because of technical, administrative, or human error.

Where a material and genuine error has occurred, we reserve the right, to the extent permitted by applicable law, to correct the error and cancel an affected order.

If payment has already been collected for an order that we cancel because of such an error, the applicable amount will be refunded.

We will not intentionally use this provision to avoid honoring legitimate advertised prices or promotions.

6. Payment

By providing payment information, you represent and warrant that:

• The information you provide is accurate and complete.

• You are authorized to use the selected payment method.

• You authorize the applicable charges associated with your order.

Payments may be processed through third-party payment service providers.

Those providers may process certain payment and transaction information according to their own terms and privacy practices.

We may use reasonable fraud-prevention measures and may request additional information or verification before processing or shipping an order.

Failure to provide requested verification may result in delay or cancellation of the order where reasonably necessary to protect against fraud or unauthorized transactions.

7. Fraudulent Transactions and Payment Disputes

We take payment fraud seriously.

You must not knowingly place an order using unauthorized payment information, provide false information, attempt to obtain products without legitimate payment, or submit a knowingly false payment dispute or chargeback.

If you believe there is a problem with an order, we encourage you to contact us first at support@nitrowatches.com so that we have an opportunity to investigate and resolve the issue.

We may provide transaction records, delivery confirmation, communications, acceptance of these Terms, and other relevant evidence to payment providers or financial institutions when responding to payment disputes.

Nothing in this section prevents you from exercising legitimate rights available through your card issuer, payment provider, or applicable consumer protection law.

8. Shipping and Delivery

Orders are shipped according to our Shipping Policy and the shipping information displayed during checkout.

Any delivery dates or delivery timeframes provided by NitroWatches or a shipping carrier are estimates unless expressly stated otherwise.

International shipments may experience delays caused by customs processing, carrier disruptions, weather, transportation problems, government action, security inspections, peak shipping periods, incorrect delivery information, or circumstances outside our reasonable control.

We will comply with any delivery obligations imposed by applicable consumer law.

You are responsible for providing complete and accurate delivery information.

Please review your address carefully before submitting your order.

9. Incorrect Addresses and Failed Deliveries

NitroWatches is not responsible for delivery problems caused by incorrect, incomplete, outdated, or misleading shipping information supplied by the customer, except to the extent otherwise required by law.

If an order is returned because of:

• An incorrect or incomplete address;

• Failure to collect the shipment;

• Refusal of delivery;

• Repeated unsuccessful delivery attempts; or

• Another circumstance reasonably attributable to the recipient,

we may require payment of additional shipping or return costs before reshipping the order, where permitted by applicable law.

Any refund associated with such an order will be handled according to our Return & Refund Policy and applicable consumer law.

10. International Orders, Customs, and Taxes

International orders may be subject to customs inspections, import duties, taxes, brokerage charges, handling fees, or other charges imposed by the destination country.

Where such charges are not expressly included and collected by NitroWatches during checkout, they may be the responsibility of the recipient, subject to applicable law and the disclosures provided before purchase.

Customs procedures and charges are controlled by the relevant authorities and are outside NitroWatches' direct control.

Customers are responsible for ensuring that products they order may lawfully be imported into their destination country.

11. Order Cancellation

If you want to cancel an order, contact us at support@nitrowatches.com as soon as possible.

We can generally cancel an order only if the cancellation is processed before the order enters fulfillment or is shipped.

Because orders may begin processing shortly after purchase, submitting a cancellation request does not guarantee that the order can be stopped.

After an order has entered fulfillment or has shipped, it may need to be handled through our Return & Refund Policy instead.

This section does not limit cancellation or withdrawal rights that applicable consumer law grants to you.

12. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Our voluntary return policy may impose eligibility requirements for change-of-mind returns, including requirements relating to product condition, original packaging, return authorization, return periods, and return shipping.

Different rules may apply to defective, damaged, incorrect, or nonconforming goods.

Nothing in our Return & Refund Policy or these Terms limits a remedy that we are legally required to provide.

13. Damaged, Defective, or Incorrect Products

If an order arrives damaged, defective, incorrect, or materially different from what was ordered, contact us at support@nitrowatches.com.

We may reasonably request photographs, video, packaging information, shipping labels, serial or identifying information, or other evidence needed to investigate the issue.

Where required by applicable law or an applicable warranty, an appropriate remedy may include repair, replacement, exchange, refund, or another legally permitted solution.

14. Product Warranty

Certain NitroWatches products may include a limited commercial warranty.

Where a product is advertised as including a warranty, the specific warranty terms supplied with the product or published by NitroWatches apply in addition to these Terms.

A commercial warranty does not replace or reduce statutory rights that apply to defective or nonconforming products.

Unless otherwise stated in the applicable warranty, warranty coverage does not extend to issues caused by:

• Normal wear and tear;

• Accidental damage;

• Improper handling or storage;

• Misuse or abuse;

• Unauthorized modification or repair;

• Failure to follow product instructions;

• Damage caused by circumstances outside the product's intended specifications; or

• Cosmetic deterioration resulting from ordinary use.

15. Personal Use and Resale

Products purchased through NitroWatches are intended primarily for legitimate personal or gift use unless otherwise agreed with us.

You may not use the Service to engage in fraudulent purchasing, unauthorized commercial resale, deceptive marketing, or other activity that violates applicable law or our intellectual property rights.

We may reasonably limit quantities or refuse unusually large orders where we believe they involve fraud, unauthorized resale, abuse of a promotion, or other improper activity.

16. Promotions, Discounts, and Promotional Codes

Promotions, sales, discount codes, giveaways, and other offers may be subject to separate conditions.

Unless otherwise stated:

• Promotional codes have no cash value.

• Promotional codes may not be combined with other offers.

• Promotions may be limited by product, customer, location, quantity, or time period.

• Promotional offers may end when the applicable promotion expires or available promotional inventory is exhausted.

We may cancel or correct a promotion affected by a genuine technical or pricing error, subject to applicable law.

We will clearly communicate material conditions applicable to promotional offers.

17. Intellectual Property

The Service and its original content, design, graphics, photographs, videos, logos, branding, text, software, layout, and other materials owned by NitroWatches are protected by applicable intellectual property laws.

Unless expressly authorized, you may not:

• Copy or reproduce our content for commercial purposes;

• Republish or distribute our original photographs or videos;

• Use our branding in a manner likely to create confusion;

• Scrape or systematically extract content from the Service;

Permission is not required for uses that are expressly permitted under applicable law.

Third-party trademarks, vehicle names, manufacturer names, logos, and other intellectual property referenced on the Service, if any, remain the property of their respective owners.

Reference to a third-party brand does not by itself imply sponsorship, authorization, affiliation, or endorsement unless we expressly state otherwise.

If you submit a review, photograph, comment, testimonial, suggestion, or other content to NitroWatches, you represent that you have the right to provide that content.

You must not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, malicious, or intentionally misleading.

Where you voluntarily submit content for publication, you grant NitroWatches a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and publish that content in connection with our business and marketing, subject to applicable privacy and consumer protection laws.

This does not transfer ownership of your original content to NitroWatches.

24. Limitation of Liability

To the maximum extent permitted by applicable law, NitroWatches will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from your use of the Service where such liability may legally be excluded.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Nothing in this section limits your statutory rights or any remedies that applicable consumer protection laws require us to provide.

25. Circumstances Beyond Our Reasonable Control

We will not be responsible for a delay or failure to perform an obligation where that delay or failure results from circumstances genuinely outside our reasonable control, except where applicable law provides otherwise.

Such circumstances may include natural disasters, severe weather, war, civil disturbance, government restrictions, epidemics, carrier interruptions, customs delays, infrastructure failures, widespread internet or telecommunications outages, labor disruptions, or similar events.

This provision does not remove any refund, cancellation, delivery, or other consumer rights that applicable law provides when such circumstances occur.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining provisions will continue in effect.

30. No Waiver

If NitroWatches does not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce that provision.

A waiver of one breach does not constitute a waiver of any later breach.

31. Entire Agreement

These Terms, together with policies expressly incorporated by reference, constitute the agreement between you and NitroWatches concerning your use of the Service and purchases made through it, except where additional terms are expressly agreed.
